The Supreme Court stated that it is already challenging to find qualified lawyers to accept the appointment to the Bench in High Courts and adding more judges will not remove the ongoing issue of court proceedings. According to the court Judges, the simpler remedy to remove the delays of pending cases was to file a petition of public interest litigation (PIL) and ask to double the number of judges in the High Courts and the district judiciary.

Ashwini Kumar Upadhyay, the petitioner’s lawyer, was questioned by the Chief Justice of India D.Y. Chandrachud if he wanted the Supreme Court to expand its judicial strength from the present 34 to 70 judges. According to Mr. Upadhyay, there are 50 judges per million people in developed nations,  and the district judiciary alone has at least 10 crore pending cases.

The current Chief Justice of India said that The American Supreme Court will not hear this type of petition. The fact that we have increased the availability of the Supreme Court to the point where it is becoming inefficient to respond to all the cases at the right time.
